In accordance with 29 CFR §1614.105 (a) Aggrieved persons who believe they have been discriminated against on the basis of race, color, religion, sex, national origin, age, disability, or genetic information must consult an EEO Counselor prior to filing a complaint in order to try to informally resolve the matter. (1) An aggrieved person must initiate contact with an EEO Counselor within 45 days of the date of the matter alleged to be discriminatory or, in the case of personnel action, within 45 days of the effective date of the action.

Applicants, employees and former employees, also known as an aggrieved person/individual or Complainant must contact the NAVSUP EEO office within 45 calendar days of an alleged discriminatory event, or within 45 calendar days they become or is made aware of an alleged discriminatory event.
After the aggrieved person has made initial contact with the EEO office, an EEO Counselor will be assigned to counsel the aggrieved person’s case. During the Informal complaint process, an aggrieved person can elect traditional counseling or the Alternate Dispute Resolution (ADR) process.
If the aggrieved elects “Traditional Counseling”, the EEO Counselor will have 30 calendar days to conduct a limited inquiry into the allegations/claims made to resolve the complaint at the lowest level. If the aggrieved elects the ADR process, the processing of the complaint will be extended an additional 60 not to exceed 90 calendar days.
If the complaint is not resolved at the end of the 30th calendar day for traditional counseling or the 90th calendar day with ADR; the aggrieved individual will receive a final interview and will be issued a Notice of Right to File a Formal Discrimination Complaint.
The Informal complaint process will end and the aggrieved individual has 15 calendar days to file a Formal Discrimination Complaint after receiving the Notice of Right to File a Formal Discrimination Complaint.
The Formal complaint process begins after the aggrieved person has received their Notice of Right to File a Formal Discrimination Complaint and returned their Formal Discrimination complaint to the NAVSUP EEO office within 15 calendar days.
After receipt of the aggrieved person’s Formal complaint, an EEO Counselor will review the complaint for acceptance for investigation or a procedural dismissal in accordance with the 29 CFR § 1614.107.
If the aggrieved person’s complaint is accepted for investigation, an assigned Investigator will conduct the investigation within 180 calendar days from the date the formal complaint was filed.
After completion of the investigation, the aggrieved person will receive their Report of Investigation (ROI) and issued a Notice of Decision- to elect a hearing by an EEOC Administrative Judge or a Final Agency Decision by the Department of Navy without a hearing.
